Terms of Use

These Terms are an agreement between you and Sports Coaching AI (“we”, “us”) for your use of the PeakTracker apps for iPhone and Android and this website (together, “PeakTracker”). By creating an account or using PeakTracker you agree to these Terms and to our Privacy Policy. If you don't agree, don't use PeakTracker.

Safety first. PeakTracker is a statistics and social app, not a safety or emergency device. Don't rely on it to find people, navigate, avoid hazards or call for help. In an emergency contact ski patrol or local emergency services directly.

1. Who can use PeakTracker

You must be at least 13 years old (or the minimum age for digital consent where you live) to create an account. If you're under 18, you must have permission from a parent or guardian. You may not use PeakTracker if we've previously banned you.

2. Your account

You sign in with Google or Apple. Keep that account secure; you're responsible for activity on your PeakTracker account. Choose a display name that doesn't impersonate anyone and isn't offensive. You can delete your account at any time in the App (Settings → Account → Delete Account) or at /delete-account.

3. Community standards: zero tolerance for objectionable content and abusive users

PeakTracker includes content created by users: display names and profile photos, snow reports and comments, group session names, and leaderboard entries. We have zero tolerance for objectionable content or abusive behaviour. You agree not to post, share or do anything that:

harasses, bullies, threatens, stalks or intimidates anyone, including using group sessions or live location to follow someone;
is hateful or discriminatory, or promotes violence, against people based on race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation, age or any other protected characteristic;
is sexually explicit, pornographic or exploits or endangers minors in any way;
is violent, graphic, defamatory, obscene, or promotes self-harm or illegal activity;
impersonates another person or organisation, or misrepresents your affiliation;
is spam, advertising, scams, or deliberately false snow or safety information that could put people at risk;
falsifies leaderboard results (for example by simulating GPS data or tracking in a vehicle);
shares someone else's personal information without their permission;
infringes anyone's intellectual property or privacy rights.

Report and block. You can report any user, profile, snow report, group session or leaderboard entry from within the App, and you can block users so you no longer see their content or receive requests from them. You can also email hello@sportscoaching.ai.

What we do. We review reports and act on objectionable content within 24 hours by removing the content and, where appropriate, removing the user who posted it. We may remove content, reset display names, suspend or permanently ban accounts, and remove a banned user's public content, at our discretion and without notice, for violations of these Terms. If you think we made a mistake, contact us.

4. Your content

You own the content you post. You give us a worldwide, non-exclusive, royalty-free licence to store, display and distribute it within PeakTracker for as long as it's on the service, so that we can show it to the users it's meant for (for example your snow report to other users). This licence ends when you delete the content or your account, except where other users have already received it in a share link you created.

5. Safety and accuracy

Skiing and snowboarding are dangerous. You're responsible for your own safety and for following resort rules, trail closures, ski patrol instructions and the skier responsibility code.
Statistics (speed, vertical, distance, run detection), maps, trail data, weather and user snow reports may be inaccurate, delayed or incomplete. Don't use them to decide whether terrain or conditions are safe.
Don't use your phone while moving on the slopes or riding a lift. Check PeakTracker when you're stopped in a safe place.
Group sessions and live location depend on mobile coverage and battery and may stop updating without warning. They are not a way to locate a missing or injured person.
Background GPS tracking uses battery. Make sure your phone has enough charge for emergencies.
Calorie figures are estimates for information only and are not medical advice.

6. Acceptable use

Don't misuse PeakTracker: don't try to access other users' data or our systems without permission, interfere with or overload the service, scrape it, reverse engineer it except where the law allows, or use it for anything illegal.

7. Third-party services

PeakTracker relies on services such as Google and Apple sign-in, maps, OpenStreetMap trail and resort data, and Open-Meteo weather data. Their own terms apply to them, and we're not responsible for them. The App Store and Google Play terms also apply to your download of the App. Apple and Google are not parties to these Terms and have no obligation to provide support or maintenance for the App.

8. Changes and availability

PeakTracker is provided free of charge. We may add, change or remove features, and may suspend or stop the service. We'll update these Terms from time to time; if a change is significant we'll ask you to accept the new version in the App. Continuing to use PeakTracker after the new version takes effect means you accept it.

9. Termination

You can stop using PeakTracker and delete your account at any time. We may suspend or terminate your access if you break these Terms, if required by law, or to protect other users. Sections 4 (for content already shared), 5, 10, 11 and 12 survive termination.

10. No warranty

PEAKTRACKER IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, RELIABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DON'T WARRANT THAT IT WILL BE UNINTERRUPTED, ERROR-FREE OR THAT DATA WON'T BE LOST.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, OR LOSS OF DATA ARISING FROM YOUR USE OF PEAKTRACKER OR OF SKI AREAS, OR FROM CONTENT POSTED BY OTHER USERS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO PEAKTRACKER IS LIMITED TO USD 50. Some jurisdictions don't allow these limitations, so they may not apply to you; nothing in these Terms limits liability that can't be limited by law, or your statutory rights as a consumer.

12. General

These Terms are governed by the laws of the place where Sports Coaching AI is established, without regard to conflict-of-law rules, except where the law of your country of residence requires otherwise. If a provision is found unenforceable, the rest stays in effect. Our failure to enforce a provision isn't a waiver. These Terms and the Privacy Policy are the entire agreement between you and us about PeakTracker.
